Only engineering degree not allowed – SEBI Regulations

Disclaimer: While this post is my experience with SEBI application process over the past years, the regional offices of SEBI may interpret the regulations differently and hence have different requirements. Before making the application, it is suggested to confirm whether you meet the qualification criteria with SEBI’s regional office near you .

“I am an engineer (B.E. – Electronics) working with an electrical company. I have been investing in the stock market for the past 5 years and have been rewarded well. I also give trading tips to my friends and family members. I am passionate about stock markets and now am planning to register myself an Investment Adviser. Do I meet the qualification requirements?”

I have been receiving a lot of similar queries from individuals who want to register themselves either as Investment Advisers (IA) or Research Analyst (RA) with SEBI.

If you are reading this post, you too have, probably, faced a similar situation. Are you wondering whether your degree fulfills the requirements of SEBI?

Both IA and RA regulations have mentioned the qualification and certification requirements under Regulation 7(1) and Regulation 7(2).

For fulfilling the certification requirement, you have to take up the NISM exam specified by SEBI.

For IAs – NISM-Series-XA: Investment Adviser (Level 1) Certification and NISM-Series-XB: Investment Adviser (Level 2) Certification. You have to complete both the levels.

Alternatively, you can also do other certifications which is accredited by NISM for Investment Advisers. Click here to know more.

For RAs – Its NISM-Series-XV: Research Analyst Certification.

Fulfilling the certification requirement is easy. The main hurdle is meeting the qualification requirements.

What qualifications fulfill the criteria for RA?

As per SEBI, you should have a post graduate degree or post graduate diploma in any field related to business or finance. If you have any one of the following degrees, you meet the qualification requirements.

  • Chartered Accountant (ICAI)
  • Company Secretary (ICSI)
  • Cost Accountant (ICWA)
  • MBA in Finance
  • M.Com
  • Masters Degree in Economics
  • Post graduation in Banking and Finance

The above qualifications have to be from a university which is recognized by UGC or from an institute/ association/university established by the central government or state government.

In case of Research Analyst, SEBI has added one more clause which is not added for Investment Advisers. If you have any professional qualification or post-graduate degree or post graduate diploma which is accredited by AICTE or NAAC or National Board of Accreditation, you meet the criteria.

What if you do not have any of these?

If you are a graduate in any field, be it commerce or otherwise, you should have atleast 5 years of working experience in activities related to financial products or markets.

You need to get an experience certificate from your employer mentioning the relevant experience.

What are the qualification criteria for RIA?

As per the amendment regulations to IA Regulations, 2013, you need to have a post graduate degree or diploma in finance, business management, economics, banking, insurance or actuarial science or insurance and risk management plus 5 years of relevant experience to meet the requirements for Investment Advisers application.

Click here to read the enhanced qualification requirements for RIAs.

Investing in stock markets for your own personal benefits and for family does not count as experience.

However, if you have been writing a blog or have been contributing articles related to research of financial products or personal finance, and you can submit links of the same, then SEBI may consider it as relevant experience for research analyst application.

Now, if you are bachelor in engineering, or a doctor or a graduate with no relevant working experience, you DO NOT meet the qualification requirements.

What about other NISM courses?

Yes, NISM offers various post-graduate courses. But most if them are certificate programs. If they offer a degree or a diploma, then they will help you fulfill the qualification requirements.

Is there any other option?

Of course, there are options. You can enroll for courses which offer post graduate degree or diploma. You have to make sure that the courses are from a university or an institute recognized by the central government or any state government or a recognized foreign university or institution.

E.g. You can do a MBA in Finance from a recognized university or do a post graduation in commerce.

Only when you meet the qualification and certification requirements you should go ahead with your application as a Research Analyst or an Investment Adviser with SEBI.

  1. Hi I am in Engineer,(Btech, computer science).
I have an active ARN number from 2021.

I educate people about personal finance(Loan/MF/Stocks/Planning/Risk Management) for 2 months (No tip provided in that 2 months).
I charge for this 2 months – Is charging for education – problem for SEBI?

    Now,
I am thinking to register for SEBI investment advisor.
    But to become eligible
For Qualification – I am planning to do MBA in Finance (1 year, From DY Patil University)
For Experience – I will show my MFD experience (by 2026 I will complete 5 yr)
from eligibility stand point is my thought process correct??
    Please do help

    Reply
    • Hi Lokesh, in my view, charging for providing only education without names of any stock / mutual fund / derivatives will not be a problem for SEBI.
For education qualificaiton, the course has to be for 2 year duration. You can also consider this – https://www.nism.ac.in/pgpipr/
MFD experience for atleast 5 years is currently considered by SEBI for fulfilling the experince criteria. However, you will have to surrender your MFD license to get registered as an RIA.
Hope this helps. For any further query, please send an email to kruti@cskruti.com

  2. Hello. Let me know if the following qualification works or not.

There is this course from IGNOU in Post Graduate Diploma Programme in Financial Management. If we go for this course, is it valid for applying as Research Analyst (of course along with NISM Research Analyst Certificate).

    http://www.ignou.ac.in/ignou/aboutignou/school/soms/programmes/detail/192/2

The above link is the PGDM programme in Financial Management. I am an engineer and have been active in market since 5+ years. But I am struggling to meet qualification requirements. Any help with qualification advice will be helpful. Thanks.

    • Hi Nisarg, in my view, if the university is recognised by UGC or is established by the central government or state government, then you can go ahead. Alternatively, SEBI will also accept if the PG degree or diploma is accredited by AICTE or NAAC or NBA.

        Reply
        • Hi Jagdish. From qualification requirements point of view, since you do not have 5 years of experience in advice in financial products / securities, you do not fulfill the RIA regulations requirements.
Post graduation in commerce will help you fulfill the qualification requirements of RA regulations.
However, whether to apply for RIA or RA license will depend on what kind of services do you plan to provide.

if not can u suggest some university for masters course that will comply

    • Hi Sunand, I am assuming you are registered with AMFI. SEBI in the past has accepted experience in selling mutual funds and stock broking for RA application. Hope you have a valid ARN certificate. However, SEBI may ask you to surrender your mutual fund distribution license and AP license if you want to get registered as a RA.

So, an undergrad engineer can acquire an “insurance agent license” or “ARN” license after completing IRDAI and NISM certification respectively.

Then, after 5 years, having the above licenses as professional experience, along NISM Level 1,2 certifications he can apply for IA or RA.

    Did I summarise correctly?

If one of your employees gets registered with SEBI, the certificate will come in his/ her name and he / she will be responsible for compliance of the regulations. Perpetual registration means SEBI registration certification does not have a validity date but the applications have to pay renewal fee every 5 years.

First of all, to apply for registration as research analyst, you need to fulfill the qualification criteria. In your case, you have not completed your graduation. As per the regulations, the minimum qualification is a graduate in any field. Once you have a degree, you will be eligible to apply.

If your brother opens an investment firm, assuming a proprietorship, he will have to fulfill the qualification and certification requirements under Investment Advisers / Research Analyst Regulations. Assuming he does and you plan to join him, say as an employee, even then you need to fulfill the requirements if you are involved in providing research related services.

Hope I have answered your query.

In case you need further clarification, pls write to me at kruti@cskruti.com.
